Florida law requires that before filing a medical malpractice case, a pre-suit investigation must be conducted. Part of that pre-suit investigation requires an affidavit or certificate of merit from an expert with similar or same credentials as the potential defendant. This affidavit or certificate of merit must be served with a notice of intent letter.
