Medical malpractice cases are complex and difficult, and require several steps in the process prior to litigation. Before a lawsuit can be filed in Florida for a medical malpractice action or for wrongful death action, the statutes in Florida require a process called pre-suit. A pre-suit period requires notification to the potential defendant of your intention to file a lawsuit, and there are many items on the checklist that must be accomplished during that pre-suit period.
