Does a bad outcome from a doctor mean that medical malpractice has occurred?
Video Transcription:
No. Every circumstance is different. In order to have a medical malpractice case, you must have at least two things. One, you must have a violation or breach in the standard of care, and the injuries must be related to that breach or violation in the standard of care. There are many circumstances where someone can have a bad outcome even when everything was done correctly. On the other hand, you can also have circumstances where there’s no injury or no damage in spite of malpractice, and that’s not a case either.
