Generally speaking, yes, if the survivor is a spouse of the patient who died from malpractice or if the patient was a child who was 24 years of age or younger or if the surviving child of a parent is 24 years of age or younger. There also is an exception for survivors who don’t meet those criteria if they were wholly or partially dependent upon the person who deceased for either support or financial services.
